Terms of Service

1. Acceptance of Terms

By accessing or using the Project Clarity website at lepak12.com and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

These Terms constitute a legally binding agreement between you and Lepa K12 (“we,” “us,” or “our”), the company operating Project Clarity.

2. Description of Service

Project Clarity is a Learning Identity assessment and reporting service for children in Grades 3–8. The Service generates personalized Learning Identity profiles based on a 15-question behavioral preference assessment completed by parents, with optional teacher validation.

2.1 What the Assessment Measures

The assessment consists of simple A/B preference questions (e.g., “I prefer working alone” vs. “I prefer working with others”). It identifies learning preferences across dimensions like engagement style, processing mode, and motivation patterns. It does not measure intelligence, academic ability, or performance.

2.2 What the Assessment Is Not

The Service is an educational preference tool. It is explicitly not:

  • A medical or psychological diagnostic tool
  • A clinical evaluation or screening instrument
  • A substitute for professional educational assessment, IEPs, or 504 plans
  • An intelligence test, aptitude test, or achievement test
  • A tool for making placement, tracking, or admissions decisions

3. Eligibility

You must be at least 18 years of age to create an account. By creating an account, you represent that you are a parent, legal guardian, or authorized educator of the child for whom you are completing an assessment.

Children do not create accounts or directly interact with the Service. All child data (first name, grade level, and assessment responses) is entered and managed by authorized adults.

4. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

5. Data and Privacy

5.1 Minimal Data Collection

We collect the minimum data necessary to provide the Service. For each child, we store only their first name, grade level, and assessment responses (A/B behavioral preference selections). We do not collect last names, email addresses, health information, academic records, or any other sensitive personal data about children.

5.2 AI-Generated Reports

Learning Identity reports are generated using AI. The AI receives only the child's first name (for personalization), grade band (grades 3–5 or 6–8), and computed learning scores (categorical labels like “Exploring” or “Visual-Spatial preference”). The AI does not receive last names, parent emails, school information, health data, or any other identifying information.

All AI outputs pass through safety filters that remove clinical terminology, diagnostic labels, and medical language. Results are framed as learning preferences, never as deficits or disorders.

6. Payments and Refunds

6.1 Pricing

The individual Learning Identity Report is priced at $99 per child. Classroom pricing is available on request. All prices are in US dollars.

6.2 Payment Processing

Payments are processed securely through Stripe. We never see or store your credit card details. By purchasing, you also agree to Stripe's Terms of Service.

6.3 Refund Policy

You may request a refund within 14 days of purchase if the Learning Identity Report has not yet been generated. Once a report is generated and delivered, refunds are handled on a case-by-case basis. Contact hello@lepalearning.com for refund requests.

7. Acceptable Use

When using the Service, you agree not to:

  • Provide false or misleading information
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or other user accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Scrape, harvest, or collect data from the Service without authorization
  • Use the Service to discriminate against, label, or make adverse decisions about children
  • Misrepresent assessment results as clinical diagnoses or professional evaluations

8. Intellectual Property

All content, features, and functionality — including assessment methodology, report formats, algorithms, and software — are owned by Lepa K12 and protected by copyright, trademark, and other intellectual property laws.

8.1 Your Content

You retain ownership of the data you provide (assessment responses, child's first name). By using the Service, you grant us a limited license to process this data solely for generating your Learning Identity Report, powering the Learning Coach feature, and improving the Service.

9. Report Accuracy and Limitations

Learning Identity profiles reflect behavioral preferences at the time of assessment based on 15 A/B preference questions. Results should be understood as one perspective among many.

  • Reports are not clinical diagnoses or professional evaluations
  • Reports are not substitutes for special education assessments, IEPs, or 504 plans
  • Results may differ if reassessed at a different developmental stage
  • The Service does not guarantee specific educational outcomes
  • AI-generated insights are filtered to exclude clinical and diagnostic language

If you have concerns about your child's learning, development, or behavior, consult a qualified educational professional, psychologist, or healthcare provider.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Lepa K12 shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, or any decisions made based on information provided by the Service.

Our total liability for all claims shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Lepa K12, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by updating the “Last updated” date and, where appropriate, notifying you by email. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.
